These Terms and Conditions (“Agreement”) govern the participation of children (“Participants”) in the Tech Classes for ages 6–12 (“Classes”) offered by [Organization Name] (“Organization,” “we,” “us,” or “our”). By registering a Participant for the Classes, the parent or legal guardian (“Parent/Guardian,” “you”) agrees to be bound by these Terms and Conditions. Please read this Agreement carefully before registering.
1. Program Overview
The Classes are designed to teach digital literacy, creativity, coding, and safe online practices to children aged 6–12, divided into two groups:
- Group 1 (Ages 6–9): Focuses on digital familiarity, creativity, foundational tech skills, and early logic building through modules such as Computer Basics, Typing, Creative Tech, Intro to Coding (Scratch Jr/Blockly), and Safe Online Explorers.
- Group 2 (Ages 10–12): Focuses on skill-building, logic development, creativity, and independence in tech use through modules such as Digital Productivity, Typing, Creative Design (Canva), Game Design (Scratch), Spreadsheets, Cyber Smart, and optional Robotics/Micro:bit projects.
Classes may be conducted in-person, online, or in a hybrid format, as specified at registration. The Organization reserves the right to modify the delivery format based on safety, technical, or operational needs.
2. Eligibility
- Participants must be within the specified age ranges at the start of the Classes: 6–9 years for Group 1 and 10–12 years for Group 2.
- Parents/Guardians must complete the registration process, provide accurate information, and consent to the Participant’s involvement.
- Participants must have access to necessary equipment (e.g., computer, internet connection) for online or hybrid Classes, as outlined in the registration materials.
3. Registration and Payment
3.1. Registration Process:
- Registration must be completed by a Parent/Guardian through the Organization’s official website, app, or designated registration platform.
- Registration requires accurate Participant information, including name, age, emergency contact details, and any medical or special needs.
- Submission of registration does not guarantee enrollment. The Organization will confirm enrollment via email or other communication.
3.2. Payment:
- Class fees are outlined during registration and must be paid in full before the start of the Classes, unless a payment plan is explicitly offered.
- Payments are non-refundable except as outlined in Section 4 (Cancellations and Refunds).
- Accepted payment methods are specified during registration (e.g., credit/debit card, bank transfer).
- Late payments may result in the Participant’s removal from the Classes without refund.
3.3. Discounts and Scholarships:
- Any discounts or scholarships are subject to availability and specific eligibility criteria, as determined by the Organization.
- Misrepresentation of eligibility for discounts or scholarships may result in cancellation of registration without refund.
4. Cancellations and Refunds
4.1. By the Parent/Guardian:
- Cancellations must be submitted in writing to [Organization Contact Email] at least 14 days before the Class start date to be eligible for a full refund, minus a [50%] administrative fee.
- Cancellations within 14 days of the start date are non-refundable, unless due to documented medical emergencies or other exceptional circumstances, at the Organization’s discretion.
- No refunds will be issued for missed sessions or partial attendance.
4.2. By the Organization:
- The Organization reserves the right to cancel or reschedule Classes due to insufficient enrollment, instructor availability, technical issues, or unforeseen circumstances (e.g., public health restrictions).
- In case of cancellation, Parents/Guardians will be notified promptly, and a full refund or credit for future Classes will be offered.
- The Organization is not liable for additional costs incurred by Parents/Guardians (e.g., travel expenses) due to cancellations.
5. Participant Conduct
5.1. Code of Conduct:
- Participants must behave respectfully toward instructors, staff, and peers, both in-person and online.
- Prohibited behaviors include bullying, cyberbullying, harassment, cheating, disruptive conduct, or misuse of equipment/software.
- Participants must follow instructions from instructors and adhere to safety guidelines, including internet safety protocols taught in the Classes.
5.2. Online Conduct:
- For online Classes, Participants must use appropriate usernames, profile pictures, and communication (e.g., chat, video) that align with the Organization’s values.
- Sharing inappropriate content (e.g., offensive images, links) or engaging in unauthorized activities (e.g., hacking, accessing restricted sites) is strictly prohibited.
5.3. Disciplinary Actions:
- Violations of the Code of Conduct may result in warnings, temporary suspension, or permanent removal from the Classes without refund, at the Organization’s discretion.
- Parents/Guardians will be notified of any disciplinary actions taken.
6. Safety and Supervision
6.1. In-Person Classes:
- The Organization will provide age-appropriate supervision during Class hours. Parents/Guardians are responsible for drop-off and pick-up at the designated times and locations.
- Emergency contact information must be provided and kept current.
- Parents/Guardians must disclose any medical conditions, allergies, or special needs that may affect the Participant’s safety or participation.
6.2. Online Classes:
- Parents/Guardians are responsible for ensuring a safe and distraction-free environment for online Classes.
- The Organization uses secure platforms (e.g., Zoom, Google Meet) with password protection and moderation. Participants must not share access links or passwords.
- Online sessions may be recorded for quality assurance or safety purposes. Recordings will not be shared publicly without consent.
6.3. Internet Safety:
- The Classes include modules on safe online practices (e.g., avoiding phishing, protecting personal information). Participants are expected to apply these lessons during and outside Class hours.
- The Organization is not responsible for Participants’ online activities outside of Class sessions.
7. Intellectual Property
7.1. Organization’s Materials:
- All Class materials, including handouts, slides, software, and code templates, are the intellectual property of the Organization or its licensors.
- Participants and Parents/Guardians may not reproduce, distribute, or modify these materials without written permission.
7.2. Participant Creations:
- Projects created by Participants (e.g., Scratch games, Canva designs, Micro:bit programs) belong to the Participant, subject to any third-party software licenses (e.g., Scratch, Canva).
- The Organization may showcase Participant projects for promotional purposes (e.g., website, social media) with Parent/Guardian consent, obtained during registration or separately.
7.3. Third-Party Tools:
- Classes may use third-party software (e.g., Scratch, Canva, Google Docs). Participants must comply with the terms of service of these platforms.
- The Organization is not liable for changes to third-party tools or their availability.
8. Liability and Indemnification
8.1. Limitation of Liability:
- The Organization, its employees, instructors, and affiliates are not liable for any direct, indirect, incidental, or consequential damages arising from participation in the Classes, including but not limited to personal injury, property damage, or data loss.
- The Organization is not responsible for lost, stolen, or damaged personal property during in-person Classes.
8.2. Assumption of Risk:
- Parents/Guardians acknowledge that participation in the Classes involves inherent risks, including technical issues, physical activities (e.g., robotics), or online exposure. By enrolling, you assume these risks on behalf of the Participant.
8.3. Indemnification:
- Parents/Guardians agree to indemnify and hold harmless the Organization from any claims, damages, or liabilities arising from the Participant’s actions, including violations of this Agreement or misuse of Class resources.
9. Privacy and Data Protection
9.1. Data Collection:
- The Organization collects personal information (e.g., Participant’s name, age, Parent/Guardian’s contact details) to administer the Classes. This data is handled in accordance with our Privacy Policy, available at PatMacTech UK Ltd’s Website.
- Emergency contact and medical information may be shared with instructors or emergency personnel as needed.
9.2. Media Consent:
- During registration, Parents/Guardians may opt in or out of allowing the Organization to use photos, videos, or projects of the Participant for promotional purposes.
- No identifiable media will be used without explicit consent.
9.3. Data Security:
- The Organization uses reasonable measures to protect personal data but is not liable for breaches caused by third-party platforms or unauthorized access beyond our control.
10. Technical Requirements
- For online or hybrid Classes, Participants must have:
- A computer or tablet with a stable internet connection (minimum 5 Mbps download speed).
- A webcam and microphone for interactive sessions (optional for some activities).
- Installed software as specified (e.g., Scratch, Canva, Zoom), which will be provided or freely accessible.
- The Organization is not responsible for technical issues on the Participant’s end (e.g., hardware failure, internet outages) but will provide reasonable support to resolve access issues.
11. Modifications to Classes
- The Organization reserves the right to modify Class schedules, content, instructors, or delivery methods (e.g., switching from in-person to online) with reasonable notice to Parents/Guardians.
- Changes will not materially alter the core objectives of the Classes, as outlined in the course modules.
12. Force Majeure
- The Organization is not liable for failure to perform obligations under this Agreement due to events beyond our control, including but not limited to natural disasters, pandemics, government restrictions, or technical failures.
13. Governing Law and Dispute Resolution
- This Agreement is governed by the laws of the United Kingdom.
- Any disputes arising from this Agreement will be resolved through mediation or arbitration in Bedford, unless otherwise required by law.
- Parents/Guardians agree to attempt good-faith negotiation before pursuing legal action.
14. Termination
- The Organization may terminate a Participant’s enrollment for:
- Non-payment of fees.
- Repeated violations of the Code of Conduct.
- Failure to meet technical or eligibility requirements.
- Termination will result in forfeiture of fees paid, and Parents/Guardians will be notified in writing.
15. Miscellaneous
15.1. Entire Agreement:
- This Agreement constitutes the entire understanding between the Organization and Parents/Guardians, superseding any prior agreements or communications.
15.2. Severability:
- If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions remain in full force.
15.3. Assignment:
- Parents/Guardians may not assign their rights or obligations under this Agreement without the Organization’s written consent.
15.4. Notices:
- All notices must be sent to the Parent/Guardian’s registered email address.
16. Acknowledgment
By registering a Participant, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. You represent that you are the legal Parent/Guardian of the Participant and have the authority to enter this Agreement on their behalf.
